Welcome to the Colmar Brunton Research and Opinions Paid Terms and Conditions of Service. Please read the following carefully:

1. Acceptance of Terms of Service
The Opinions Paid Service and the Opinions Paid Web sites (referred to hereafter as “Opinions Paid') are owned and operated by Colmar Brunton Research Pty Ltd ABN 22 03 748 981 (referred to hereafter as 'Colmar Brunton').

The Service is open for membership to individuals of age 18 years or over, or to minors of age 14 years or over with parental or guardian permission. The Service is open for membership only to residents of Australia . Membership of the Service is conditional upon acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on Opinions Paid (referred to hereafter collectively as 'Terms of Service').

The submission of the online membership application constitutes the member's acceptance of the Terms of Service. Since the member is bound by these Terms of Service, the member should periodically refer to them here.

Opinions Paid reserves the right to vary the specifications, rates, rewards, rules and conditions of any element of the Opinions Paid Service and Network facilities at any time without notice. Opinions Paid reserves the right to vary these Terms of Service by providing 30 days notice on this website.

2. Conditions of Membership
Opinions Paid reserves the right to terminate the membership of individuals who violate the following conditions of membership:

• An individual may only apply for one membership.
• Each email address can only belong to one member.
• The member must provide a valid email address.
• A maximum limit of 3 memberships per postal address applies.
• The member must not send unsolicited email ('SPAM') to strangers to promote Opinions Paid.
• An individual must not join nor use the Service on behalf of another individual.
• The member must inform Opinions Paid of any change in the member's personal details, including email address and street address. This can be done through the Profile page on the Opinions Paid Web site.
• Any other reason deemed inappropriate in the reasonable opinion of Opinions Paid.

Opinions Paid also reserves the right to terminate the membership of any individual without cause or reason.

Members of Opinions Paid may receive up to 5 invitation emails per week, to participate in Opinions Paid surveys. Opinions Paid does not send it’s members marketing or advertising material.

A question from a member will be answered within 24 hours (weekdays).  If this is not possible, an acknowledgement of receipt will be given including which will include an ultimate reaction time period.

All members eligible for participation in a study will have an equal chance to participate in the study. Invitation to participate will be based on the profile information you have supplied to Opinions Paid.

3. Payments to Members
Opinions Paid points (referred to hereafter as ‘Zoints’).shall have no cash value and the member shall have no property rights or other legal interests in points earned, unless otherwise notified by Opinions Paid.

Opinions Paid is open for membership only to residents of Australia , Opinions Paid will not send any payment by merchandise, to any address outside of Australia .

Opinions Paid reserves the right to request a copy of a proof of identification document, for account verification and security purposes, before granting a request for payment by merchandise. Where the member is unable to provide a copy of a proof of identification document, Opinions Paid may deny the request for payment by merchandise and may also, at its discretion, cancel the membership account.

The member is solely responsible for ensuring the accuracy of information provided for the purposes of delivery of payment by merchandise. Opinions Paid is not responsible for any mail handling error of any postal service involved in the delivery of a payment by merchandise.

Whilst Opinions Paid endeavours to keep the Network error free, if reward points (Zoints) are credited to a member due to a human or computer error, Opinions Paid reserves the right to adjust or reverse such a transaction without notice.

Upon termination of membership, the member will forfeit their points balance, and all outstanding rewards.

If the member does not participate in an Opinions Paid survey for 12 months their membership will be considered inactive, and will be terminated.  The member will forfeit their points balance and all outstanding rewards.

Opinions Paid points are not transferable between members or accounts.

4. Communication Facilities
The Opinions Paid Network contains electronic bulletin boards, chat rooms and other communication facilities which provide for feedback by members to Opinions Paid, real-time interaction between members and other electronic messaging and notice services (referred to hereafter as 'Communication Facilities'). It is a condition of your use of any Communication Facility and your access to the Network that you do not do any of the following:

• restrict or inhibit any other member from using or enjoying any chat room;
• post or transmit any unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane or indecent information or material of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law;
• post or transmit any material of any kind which violates or infringes upon the rights of any other person, including material which is an invasion of any privacy or publicity rights or which is protected by copyright, trademark or any other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or relevant right holder;
• post or transmit any material of any kind which contains a virus or other harmful component;
• post, transmit or in any way exploit any material of any kind for commercial purposes, or which contains any promotional material or advertising;

Violations of these terms relating to Communication Facilities may result in a suspension from posting, or cancellation of your membership.

Opinions Paid may from time to time monitor, contribute to or review the contents of its Communication Facilities for research purposes. While Opinions Paid reserves its right to edit, refuse to post or to remove any information and/or materials (in whole or in part) that in Opinions Paid sole discretion is in any way objectionable or in violation of any applicable law or the Terms of Service, Opinions Paid has no obligation whatsoever to monitor any Communication Facility or to edit, delete or refuse to post such contents, nor is Opinions Paid responsible for any contents in any Communication Facilities. You expressly acknowledge and agree that the Communication Facilities provide a means of public and not private communications.

Opinions Paid reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials which violate any applicable or relevant law.

Competitions
By entering into Opinions Paid competitions, you agree to have your name published on the Opinions Paid Web site in the case that you are a winner. Opinions Paid employees and their family members, Opinions Paid partners and clients, agents, suppliers, and their employees and immediate family are not eligible to enter any Opinions Paid competition.

Referrals
150 points (Zoints) will be awarded where the member (the 'referrer') refers a new member (the 'referred') to join Opinions Paid. Opinions Paid reserves the right to debit those points from the referrer's account where the referred account is cancelled within three (3) months. Where a fraudulent referral is discovered, Opinions Paid reserves the right to cancel either or both the referrer or referred account and/or debit the appropriate points or cash from the referrer's account.

5. Disclaimer of Warranty
The member acknowledges that it has not relied upon or been induced by any representation by Opinions Paid and makes no warranty or representation as to:

• the results that may be obtained through membership of the service;
• the accuracy, reliability or otherwise of any information obtained through membership of the service;
• the financial or other rewards which may be obtained through membership of the service;
• the service or network being uninterrupted, timely or error free;
• the goods and/or services purchased or obtained through the service or network, except where expressly indicated.

6. Limitation of Liability
The member releases Opinions Paid and its officers, employees, agents, subsidiaries and affiliates from any claim for loss, damage or liability, including special indirect or consequential loss or damage such as loss of revenue, unavailability of systems or loss of data, in respect of:

• membership of the service;
• the members use of or inability to use the Opinions Paid Network;
• the quality of goods and/or services purchased by the member;
• any dispute with a supplier of goods and/or services.

7. Indemnification
The member indemnifies and keeps indemnified Opinions Paid and its officers, employees, agents, subsidiaries and affiliates against all claims (including third party claims), demands, damages, costs (including legal costs), penalties or suits arising out of or consequential upon the members use of the service or the network.

8. Termination
These Terms of Service are effective until terminated by Opinions Paid. Opinions Paid may terminate these Terms of Service at any time without notice.

9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New South Wales and of the Commonwealth of Australia. The member submits to the jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

Privacy Statement

Opinions Paid understands that you are concerned about your privacy. That's why Opinions Paid has created this privacy and permission statement, to demonstrate our firm commitment to your privacy.

How does Opinions Paid use the information I provide?
Opinions Paid uses the information you provide in your profile to target and personalise the emails and surveys we send to you. We do this to ensure that you only receive relevant and appropriate information.

Opinions Paid will not sell or give away your personal information to any other person, company or organisation, unless:

1. it is required by law, or;

2. you expressly agree to us giving out your information.

Demographic and profile data is only shared with Opinions Paid clients on an aggregate or collective basis. For example, we might tell our clients that 3680 of our members live in a particular town or suburb, or that 43% of our members have indicated an interest in sport. However, we will never tell our clients your name, your postal address or your email address and other such information.

What happens to the answers I give in an online survey?
Opinions Paid follows strict market research guidelines that govern what happens to the answers that you give when participating in an online survey. The results of online surveys (where you are invited to participate in the survey by email) are only used for market research analysis. The information you give in these online surveys is not used to target direct marketing messages. You can be assured that any information you provide in an online survey is kept absolutely confidential.

What about security?
Opinions Paid has modern and robust security measures in place to protect the information you give to us from loss, misuse and alteration. We are constantly reviewing and upgrading these security measures to ensure the very best of protection to you.

Why does Opinions Paid record IP Addresses?
When a user joins Opinions Paid, our computers may record their IP address. In the event that we detect fraud or abuse of our program or our Web site and computers, we may use the IP address of the offender to take action against them. Ultimately this ensures greater protection for you and your personal information.

What are cookies and why does Opinions Paid use them?
A cookie is a piece of data stored on a user’s computer hard drive, containing information about that user. A cookie can only be accessed across the Internet by the Web site that placed it there. Cookies are used by the Opinions Paid Web site to add functionality and security.

You may choose to reject a cookie that the Opinions Paid Web site attempts to place on your computer, however you may then be limited in your use of some areas of the Web site. The use of cookies in this way is wide-spread and commonly accepted by the Internet community.

What about other Web sites?
The Opinions Paid Web site may contain links to other Web sites. We are not responsible for the privacy practices of these other Web sites. We encourage you to be aware when you leave our Web site and to read the privacy statements of other Web sites that you use. This privacy statement applies only to Web sites owned and operated by Colmar Brunton Research Pty Ltd.

What is "spam" and does Opinions Paid send it?
The widely accepted definition of "spam" is unsolicited commercial email, or in other words, email of a commercial nature that the recipient does not want. Opinions Paid does not send "spam". This is because when you join Opinions Paid, you must expressly agree to allow us to send to you emails.

How many emails will I receive?
We respect your time and attention. We will never send to you more than fourteen emails per week. That is a guarantee.

How can I stop Opinions Paid from sending me email?
Each email we send to you contains a link at the very bottom allowing you to unsubscribe.
